Insolvency - Corporate and Personal
WFW has had and continues to build a strong working and professional relationship with well respected and highly regarded Administrators and Liquidators.
As is the nature of insolvency, it is not uncommon for urgent advice to be called upon by an Administrator or Liquidator of a Company. WFW is well positioned in this regard having access to constantly updated resources and materials and relying on the experience of our lawyers.
We are regularly retained to assist, advise and act on behalf of Administrators with regard to, among other things, Voluntary Administrations, Deeds of Company Arrangements, Schemes of Arrangement and the like.
WFW has also acted for Liquidators in the recovery of preferential and voidable transactions and the tracing of real property and other company assets, as well as assisting both commercial and private clients with the recovery of debts through winding up and bankruptcy proceedings.
With regard to personal bankruptcy WFW has substantial experience in assisting individuals in proposing Part X arrangements and dealing with Trustees. WFW has also acted for Trustees and represented individuals in s81 Bankruptcy Act public examinations and has also been involved in actions acting on behalf of a Trustee to trace and recover assets for the benefit of creditors.
As we have developed strong working relationships with a number of Liquidators we are equally placed to advise clients experiencing difficulties with their financial affairs and, where possible, to negotiate resolutions with creditors to avoid the adverse effects of liquidation and bankruptcy.
